IT & Technology
Information technology and legal framework of on-line activities

The Firm advises start-ups and international companies on software contracts, outsourcing deals, the setting-up of on-line activities and IT services (IoT, artificial intelligence, cloud services…) as well as on computer litigation.

Data protection

The Firm assists on data protection issues by providing practical solutions for companies looking to protect their data and to comply with the new EU regulation (the “GDPR”).
The Firm can proceed to audits, advise companies on strategies for the protection and use of data and assist on the, implementation of policies relating to the use of personal data in a digital environment.

Intellectual Property
Copyright and media

The Firm assists, among others, production companies, publishing firms and artists in the management and defense of their rights attached to their works.

The Firm notably advises its clients in relation to the management and use of their intellectual and other works (drafting and negotiation of copyright agreements, of licensing agreements, advice on regulatory issues, due diligence on intangible assets) as well as in relation to the defense of their legal interests (for instance in cases of infringement, unfair competition and passing off proceedings).

The Firm also intervenes in the protection and use of image rights for goods or persons and notably, in the drafting and negotiation of contracts (image, publicity, licences) or in litigation concerning media laws and publicity rights.

Industrial property

The Firm advises and assists its clients in establishing adequate strategies to defend and promote their trademarks (branding), designs and models as well as corporate and domain names.

The Firm offers its clients a full range of services related thereto, from the creation of such intellectual property (filings, searches and prior art reviews), to ensuring its safe and proper use (management of trademark portfolios, audits, licensing agreements, coexistence agreements) and, as the case may be, defense before the courts (infringement and unfair competition proceedings, arbitration proceedings, retrieval of domain names…).

Legal Fees
Cabinet Marrache Avocat sets clear rules for the calculation of fees in agreement with its clients
  • fees calculated based on time spent by applying an hourly rate; and/or
  • a lump sum fee.

In certain cases, contingency fees may be added to the basic retainer fee.

The Firm also offers monthly or annual counsel fees based on a preferential hourly rate for a predetermined number of hours.

Legal fees do not include procedural costs, third party fees (bailiffs, experts, notaries…), out of pocket expenses or V.A.T.

Elisabeth Marrache

Elisabeth Marrache is the founding partner of Marrache Avocat. Member of the Paris Bar since 2005, with more than eight years of experience in the TMT departments of major Anglo-Saxon law firms, Elisabeth Marrache decided to create her own structure dedicated to intellectual property and digital law in 2013.

Elisabeth Marrache holds a post-graduate degree (DEA) in communication law from the University of Paris II Panthéon-Assas. She is a member of the Trade Mark and Design Law Practitioners Association (APRAM) and regularly speaks at conferences and training programs on matters relating to new technologies and personal data.

Fréderique Allier

Frédérique Allier joined the Firm in 2020 as an associate, after having completed several internships in intellectual property and digital law in French and Anglo-Saxon law firms and in the legal department of a major French luxury company.

Admitted to the New York Bar (in 2016) and to the Paris Bar (in 2019), she holds a post-graduate degree (Master 2) in European and International Intellectual Property Law from the Center for International Intellectual Property Studies (CEIPI) and an LL.M. in American Law from Golden Gate University, San Francisco
